<p>Former Valley Christian High School employee Todd Baldwin is facing federal charges for allegedly soliciting and distributing explicit images of minors. These charges arose from a San Jose Police investigation initiated in August 2023, during which Baldwin was arrested. He confessed to receiving pornographic images from several boys in exchange for money. Due to the severity and federal implications of the crimes, which involved child exploitation and the online distribution of child pornography, the case was escalated to federal authorities, resulting in FBI involvement.</p>


<p>Assistant U.S. Attorney Marissa Harris has filed two counts of “enticement of a minor” against Baldwin. These charges are based on testimonies from two minors and supporting online evidence. FBI Special Agent Colleen Dettling outlined the allegations in the federal complaint, stating that Baldwin allegedly offered a 17-year-old former teaching assistant a job in return for explicit images and videos, intending to sell them on Reddit and share the profits. Investigators found evidence supporting these claims, including records of financial transactions.</p>


<p>Additionally, a second minor, aged 16 and attending Live Oak High School, reportedly sent explicit images to Baldwin in exchange for payment. During an interview with police in August 2023, Baldwin admitted to receiving explicit images from multiple minors.</p>


<p>The investigation also revealed that on at least one occasion, Baldwin personally took sexual photographs of a teenager at Valley Christian High School and paid him several hundred dollars for them.</p>


<p>In 2021, <a href="/lawyers/lauren-a-cerri/">Attorney Lauren Cerri</a> successfully brought a <a href="/news/valley-christian-hs-sex-abuse-lawsuit/">sexual misconduct lawsuit</a> against Valley Christian for its role in enabling then basketball coach Greg Marshall to sexually abuse a young student. In regards to this case, Cerri says that it is the job of Valley Christian to supervise the students entrusted to their care and their employee, Todd Baldwin. The fact that Mr. Baldwin was able to take photographs of at least one student naked in his office shows that obviously Mr. Baldwin knew that nobody was watching him and that Valley Christian was not properly supervising him or the student. There’s no reason that something like this should have happened on school grounds. Clearly, they weren’t watching.</p>


<p>Going forward, Valley Christian needs to ensure that staff are trained and that policies and procedures are established to recognize grooming signs, such as favoritism and spending time alone with students. It’s important to have proper supervision in place so employees understand they cannot engage in these behaviors without being detected, and if they attempt to do so, they will be caught.</p>


<p>As for the victims, digital images are permanent. Once something is online, it is extremely challenging to remove, and it can persist indefinitely. Even if deleted, the boys remain aware of the potential threat that these photographs could exist forever. This can be incredibly damaging, particularly as they grow older. While they may currently be young and immature, this issue will have a lasting impact on them throughout their lives.</p>


<p>Baldwin had been employed by Valley Christian High School since 1998 but was placed on administrative leave at the start of this investigation and is no longer working there. He served as the director of operations, a teaching assistant, and a sports coach.</p>

<p>A music teacher at Adelante Dual Language Academy, Alum Rock Union School District, is facing multiple sexual abuse charges following his arrest. Israel Santiago, a music teacher, is accused of inappropriately touching at least ten students in the band room. Adelante Dual Language Academy is a transitional kindergarten through 8th grade school in East San Jose.</p>


<p>San Jose police said a similar allegation was made against Santiago in 2014 at another Alum Rock School District school, but no charges were ever filed. Santiago was then moved to Adelante Academy.</p>


<p>This case has many similarities to a case that just resulted in a <a href="/news/san-jose-jury-awards-lauren-cerri-sexual-abuse-client-65-million-dollars/">$102 million jury verdict</a> against the Union School District. In both of these cases, it appears the music instructors were isolated from the rest of the school and lacked proper supervision. And in both cases, it appears that there were several “red flag” warnings that could have stopped the abuse of students.</p>


<p>San Jose Police Department’s Internet Crimes Against Children and Child Exploitation detectives began investigating Santiago when reports of him inappropriately touching students surfaced. Santiago was arrested on November 21, 2022 and booked into the Santa Clara County Main Jail. According to Superintendent Dr. Hilaria Bauer, Israel Santiago has not been in contact with students or on school property since November 1st. </p>


<p>According to a press release from the Santa Clara County District Attorney’s office, investigators found that starting last school year the suspect would take the children in his office, which was in a relatively secluded spot. He is accused of often holding the girls on his lap and hugging them tightly to his body along with cupping female student’s buttocks and in one case he stroked the bare skin of a fourth grader’s back, underneath her bra strap. According to the police report, one of the reported victims contacted a friend via text message and described her physical contact with Santiago: “Sometimes I feel my shirt lifting up … I just don’t want to be around him.”</p>


<p>NBC Bay Area reports, “As soon as these schools, administrators, whoever become aware of these incidents, please report it to law enforcement,” San Jose police Sgt. Christian Camarillo said. “Please call us. It doesn’t mean that you’re going to have patrol cars showing up at your school. Our unit has plainclothes detectives. We want to talk to these kids as quickly as we can.” </p>

<p>A recent independent investigation revealed that the U.S. Soccer Federation has been subjecting players to systemic acts of abuse. Following a large-scale investigation with “over 200 players, coaches, owners, and front office staff across former and current USSF personnel and NWSL clubs,” Sally Q. Yates, from the King & Spalding law firm, released a 173-page report that sought to uncover complaints of misconduct, sexual harassment and abuse. 
As with previous lawsuits against large sporting organizations, the complaints dealt with players not having their complaints of misconduct taken seriously or ignored. According to the Yates report, several levels of coaches and organizational leaders “created and maintained an environment where “systemic” abuse was allowed to thrive due to a failure to act on player complaints of abuse.” As a result, players of all ages were subjected to various levels of abuse without anyone in the organization willing to help.   
Moving forward, Yates hopes that this will create change within the organization and improve transparency. Yates said, “Our investigation revealed that abuse in the NWSL is not simply about one team, one coach, or one player. It is not even just about the League. Abuse in the NWSL is rooted in a deeper culture in women’s soccer that normalizes verbally abusive coaching and blurs boundaries between coaches and players. The players who have come forward to tell their stories have demonstrated great courage. It’s now time that the institutions that failed them in the past listen to the players and enact the meaningful reform players deserve.” 
One step that the USSF organization plans to take, since this report was released, is to create a Participant Safety Taskforce. Since 2020, USSF has taken more steps to improve methods of reporting complaints such as having SafeSport coordinators oversee athlete safety and compliance; stricter background checks for employees; improve transparency to verify coaches’ licenses and offer more educational tools to prevent abuse and reporting procedures. Moving forward, U.S. Soccer President, Cindy Parlow Cone acknowledged, “U.S. Soccer is fully committed to doing everything in its power to ensure that all players – at all levels – have a safe and respectful place to learn, grow and compete. We are taking the immediate action that we can today, and will convene leaders in soccer at all levels across the country to collaborate on the recommendations so we can create meaningful, long-lasting change throughout the soccer ecosystem.”

<p>Robert Dunham was convicted and sentenced for abusing multiple students. The DA’s office issued a statement following his sentencing, stating that Dunham had a history of inappropriate conduct aimed at students and other minor children with whom he had been trusted.</p>


<p>Fickas is currently serving a 28-year prison sentence for raping and sodomizing four girls or women and for oral copulation on a teenage boy he coached at North Salinas High School. Fickas coached the girls’ junior varsity field hockey team and also acted as the varsity shot put coach for the track and field team at North Salinas High School.</p>

<p>In 2020, sexual misconduct claims were reported against a former Thacher School headmaster and two teachers. As a result, the school retained Munger, Tolles & Olson, a Los Angeles law firm, to investigate the claims. The investigation included interviews with over 120 current and former students, parents, faculty, and staff. </p>


<p>One victim reportedly described being allegedly raped by a teacher in the 1980s when she was 16 years old. The sexual abuse progressed into more violent encounters. </p>


<p>Another victim reportedly described how a teacher/soccer coach acted inappropriately by creating “an exclusive clique of students with a secret ‘initiation ritual’ that included asking girls embarrassing personal questions about their bodies.” In addition, this same teacher would allegedly give massages to female students while also groping their bodies.</p>


<p>The final claim was against a former Thacher headmaster who asked two female students to work as waitresses at a formal dinner party at his home. According to the report, the headmaster “instructed them to wear slinky and sexy clothes.” He also “deliberately dropped his napkin, then asked a female student to pick it up and put it on my lap.” </p>


<p>Unfortunately, these types of sexual abuse and sexual misconduct reports are not uncommon. Thacher acknowledged that there were repeated instances of “boundary crossings.” Even though the accused teachers and headmaster no longer work at Thacher and have not been charged, the Ventura County Sheriff department is reviewing the evidence. For the victims, their greatest fear, as students, was that they would be the ones to get in trouble. </p>


<p>Victims are often afraid to speak up and report what sexual crimes have been committed. When teachers or administration officials commit sexual misconduct, victims often feel as if they have no one to turn to.</p>


<p>Top boarding schools such as Connecticut’s <a href="https://www.thedailybeast.com/cheats/2017/04/13/12-teachers-at-elite-boarding-school-accused-of-sexual-abuse-spanning-decades" rel="noopener noreferrer" target="_blank">Choate Rosemary Hall</a> and <a href="https://www.thedailybeast.com/elite-st-pauls-school-spared-criminal-charges-in-sexual-abuse-probe" rel="noopener noreferrer" target="_blank">St. Paul’s in New Hampshire</a> have also endured sexual misconduct scandals.</p>

<p>In 2013, an explosive report by the student journalists described an alleged <a href="https://www.paloaltoonline.com/news/2013/04/09/students-journalists-explore-rape-culture-at-paly" rel="noopener noreferrer" target="_blank">“rape culture” at Palo Alto High School</a>.</p>


<p>In 2015, former Palo Alto teacher, Mike Airo, was charged and then later convicted of four felony counts of sexual abuse of a minor. The abuse reportedly went back a decade, and concerned a victim known in court as “Anne Doe.” She claimed she was 11 when Airo allegedly began abusing her.</p>


<p>The Palo Alto school board voted unanimously to dismiss Airo shortly after his arrest—Airo taught 4<sup>th</sup> and 5<sup>th</sup> graders at Ohlone, in the Palo Alto Unified School District, beginning in 2009.
</p>


<h3 class="wp-block-heading">Another former Palo Alto teacher pleads “no contest” to sexual abuse of a student</h3>


<p>
Another former Palo Alto teacher, Ronnie Farrell, was arrested in 2017 for committing sex crimes against a student. Farrell pled no contest, and was sentenced to two years and eight months in prison with no probation.</p>


<p>Farrell taught chemistry and biology. He resigned from his teaching position on the same day he pled no contest to the charges.
</p>


<h3 class="wp-block-heading">Formal letter of findings sent to Palo Alto Unified School District</h3>

In light of the above incidents, as well as other claims of sexual harassment and sexual abuse in the Palo Alto Unified School District, the U.S. Department of Education’s Office for Civil Rights sent a formal letter of findings to the district, following an investigation. The letter stated the district repeatedly failed to respond to and investigate sexual harassment and sexual assault reports in a prompt and equitable manner.  According to the letter, this failure to respond and investigate resulted in violations of the federal anti-discrimination law Title IX.</p>


<p>After receiving the letter, the Palo Alto school board unanimously approved a resolution which would commit the district to addressing the violations employing a range of efforts. The letter’s findings detailed the school districts dismal failure even in following its own policies and procedures in eight separate sexual harassment, misconduct and assault cases which involved teachers, staff, an administrator and students, beginning in 2013. The report clearly illustrated a culture in which the staff either delayed, or entirely resisted keeping records of Title IX incidents in the Palo Alto Unified School District.   Further, the Office for Civil Rights expressed concern regarding the fact that while the districts <em>did</em> investigate the allegations against Farrell and Airo, those investigations were unreasonably delayed.
</p>
