Twin Rivers Unified School District Settles Sexual Abuse Lawsuit for $6 Million

The San Jose-based law firm of Cerri, Boskovich & Allard reports that it has reached a six-million-dollar settlement in a civil sexual abuse lawsuit against the Twin Rivers Unified School District. The firm brought the case after former Del Paso Heights Elementary School teacher Kim Wilson was arrested for sexually abusing the young student years earlier.

“This settlement should serve as a warning to parents and educators about the dangers of teachers who disguise themselves as caring mentors but are actually predators, especially as the new school year begins and students return to classrooms” attorney Lauren Cerri said. “It is a stark reminder for parents, educators, and administrators to remain vigilant and proactive in safeguarding children as they head back to school.”

The civil case alleged that the district failed in its obligation to properly supervise Wilson, allowing his misconduct to go unchecked for years.

The lawsuit claimed that during the 2014-2015 school year, when the victim (referred to as Jane Doe) was in sixth grade, Wilson used his authority as head of the school’s broadcast group to isolate her in a locked, windowless, soundproof room, where the sexual abuse took place.

Attorney Lauren Cerri emphasized that all abuse occurred on school grounds while both Wilson and Jane Doe should have been under district supervision. She condemned the administration for its failure to protect her client and other students from this teacher especially in light of prior complaints made by yard duty supervisors years earlier that Wilson was spending time in his classroom during every single lunch recess with female students. Those complaints fell on deaf ears.

Wilson was accused of sexually abusing at least five students, some as young as eight. He pled guilty in 2025 to nine counts of lewd acts upon a child and admitted to allegations involving multiple victims and was sentenced to 215 years to life in prison.

The investigation into Wilson’s conduct uncovered disturbing information. In February 2020, fifth-grade students reported his verbal and emotional abuse, including racist slurs like calling a Black student a "burnt cockroach," mocking an overweight student, swearing at students, spraying water on them, and using derogatory names. A parent also raised concerns about his professionalism. Despite these findings and a reprimand for violating teaching standards, Wilson was not fired.

In April 2021, Wilson was placed on leave again amid new allegations of continued inappropriate behavior, including making racist remarks, swearing, and writing the N-word on a blackboard while asking a Black student if it was offensive. The district found he violated teaching standards once more but issued only a letter of reprimand.

Attorney Cerri insists the district’s lack of oversight enabled Wilson’s “serial predation,” stating that more rigorous supervision would have prevented such abuse.
